mine came with a small load of staples so ready to use.

Hmmmm ... Not dead flat, which I confess seems a bit odd to me - it opens to about 30 degrees short of dead flat.. You could SORT OF use it that way, but if that was a 'major requirement' I would choose a different stapler myself.
